			<content:encoded><![CDATA[<p>On January the 12th Google announces on it&#8217;s official <a href="http://googleblog.blogspot.com/2010/01/new-approach-to-china.html" target="_blank">blog</a> that their and other companies&#8217; servers have been the target of sophisticated attacks from China. In the Google Inc official statement there&#8217;s not much information concerning these attacks. Were they real? There is no evidence on this matter.</p>
<blockquote><p><em>Like many other well-known organizations, we face cyber </em><strong><em>attacks</em></strong><em> of varying degrees on a regular basis. In mid-December, we detected a highly sophisticated and targeted attack on our corporate infrastructure originating from China that resulted in the theft of intellectual property from Google. (…) First, this attack was not just on Google. As part of our investigation we have discovered that at least twenty other large companies from a wide range of businesses&#8211;including the Internet, finance, technology, media and chemical sectors&#8211;have been similarly targeted. We are currently in the process of notifying those companies, and we are also working with the relevant U.S. authorities.</em></p></blockquote>
<p>Google also states that the primary goal of the attackers was accesing the e-mail accounts of Chinese <strong>human right</strong> activists.  After these events, Google Inc company threatens withdrawal from the chinese market if the Beijing government will continue the internet censorship policy.</p>
<p>Perhaps you don&#8217;t know but google.cn is constrained to filter it&#8217;s results. For example, if someone in China is looking up for some informations about Tiananmen Square will not receive any result on the bloody events that took place in this market on the 14th of April 1989.</p>

<p>I really don&#8217;t like Google&#8217;s hypocrisy:</p>
<blockquote><p><em>We launched Google.cn in January 2006 in the belief that the benefits of increased access to information for people in China and a more open Internet outweighed our discomfort in agreeing to censor some results.</em></p></blockquote>
<p>Google didn&#8217;t went to China to offer the chinese people a good source of information, it went there to <strong>make profit</strong>. Google Inc is a company, a business that needs profit. If, for any reasons, it would stop making profit, it would shut down. By offering a source of information is just the way Google is making money.</p>
<p>Yesterday, the <strong>american administration</strong> declared that they support Google in it&#8217;s actions:</p>
<blockquote><p><em>We support [Google's] action &#8230; in a decision to no longer censor searches that happen using the [Google] platform,&#8221; Gibbs told reporters. He added that &#8220;our concern is with actions that threaten the universal rights of a free Internet.<br />

<p>Now let&#8217;s see what we have here:</p>
<p>- Google Inc. is one of the biggest and most important American companies, and it has some problems on the chinese market, a market of approximately 350 million users<br />
- Google Inc. <a href="http://www.onedaywithoutgoogle.org/blog/google-policy-or-googlization-of-politics/" target="_blank">supported the actual american administration in it&#8217;s election</a></p>
<p>Is the american administration paying debts from the election to Google, or are we talking about politicizing Google Inc.? Can we continue to trust in the services Google is offering us?</p>
<p>It&#8217;s very important that the events in Tiananmen Square do not repeat and the human rights to be respected in all countries. What&#8217;s happening in China is a serious problem regarding human rights and acces to information but we don&#8217;t believe that this approach is the best idea.</p>
<h3>About the title of this article</h3>
<p>There was no internet in 1939 and the means of mass information were represented by the radio and the newspaper. Gliwice is a small town in the South of Poland, in 1939 it belong to Germany and it was called <strong>Gleiwitz</strong>. On August the 31st a local radio station is attacked and occupied, the show is suddenly interrupted and a voice full of hate instigates the polish people to kill any german in their way. On September the 1st World War II unleashes. The occupation of the radio station was a german mission, a false pretend for taking over Poland an unleashing the war. 			<content:encoded><![CDATA[<p>John Zorn is a man of metropolis, a men who suits the relation with the other above us, from the 34th floor. It gives him the joy of the first meet, the discovery of one&#8217;s being through the eyes of the interlocutor.</p>
<p><a href="http://www.muzicadevest.ro/" target="_blank">Muzicadevest.ro</a> (which means West Music and it&#8217;s another website of mine) got credentials at one of the oldest <a href="http://en.ljubljanajazz.si/home" target="_blank"><strong>Jazz Festivals in Europe</strong></a>, the one in Ljubljana, that reached it&#8217;s 50th edition. The festival that invited, at it&#8217;s last night, <strong>John Zorn</strong>.</p>
<p>How is it in Ljubljana? I think it&#8217;s an uncharacteristic european capital. Provincial, and in the same time daintily, full of fresh green and beautiful, pleasant establishments.</p>
<p style="text-align: left;">I am trying to tell you now how it was at John Zorn&#8217;s concert, technical details: i didn&#8217;t think the location, being in an opened space, would have given the possibility of such an impeccable sound, but i was wrong, the sound was incredible. About 1000 people filled the Križanke open air theatre&#8217;s amphitheatre, the instruments of the monitor men were brought by the men from <strong>Medeski Martin &amp; Wood</strong>. The ticket price was around 30 €, the concert was more than 4 hours long and there were 12 musicians involved on the stage.</p>
<p style="text-align: center;"><a href="http://farm4.static.flickr.com/3577/3693295555_470707d7b8_o.jpg"><img class="aligncenter" style="border: 2px solid #808080;" title="John Zorn" src="http://farm4.static.flickr.com/3577/3693295555_4594ae9982_m.jpg" alt="" width="164" height="240" /></a></p>
<p style="text-align: left;">20:07 hours, two prying eyes behind some geeky glasses, a red t-shirt with cabalistic symbols and the famous camouflage pants of the Mossad, plus the saxophone, lustreless  from the acidity of the unforeseeable sounds. Zorn, John Zorn. One sock yellow, one red.</p>
<p>40 minutes of &#8220;zornish&#8221; improvisations</p>
<p>A show beginning I&#8217;ve never seen before. Full of strength, you had no way to resist the attack directed by Zorn. On the stage,  short-reel films seemed to unwind, with different actors, but the same director.  Marc Ribot, Trevor Dunn, Joey Baron, Cyro Baptista, Chris Wood, Billy Martin, Kenny Wollesen, Jamie Saft succeeded each other in an awesome rhythm.</p>
<p>A Cyro Baptista which seemed like Frank Zappa, in look and the irony and cynicism of rendition, a Trevor Dunn that i confused with a timid child, lucky i recognized the bass, a Marc Ribot that was industrious doing his job, treating his guitar like a Salem witch and unstoppable in vary occasions (lucky chance that Zorn tempered him), a permanent smile of Joey Baron from behind the drums, a dervish dance of Kenny Wollesen, the vibraphonist. And John Zorn&#8217;s saxophone above them, and especially, his presence. As usually, backing the audience, facing the artists, &#8220;by director&#8221; Mr. John Zorn.</p>
<p>What did this gang sing? This i can not tell you, it&#8217;s impossible for me. <strong>Google can&#8217;t tell you either <img src='http://www.onedaywithoutgoogle.org/blog/wp-includes/images/smilies/icon_smile.gif' alt=':)' class='wp-smiley' /> </strong></p>
<p>After a 15 minute break, &#8220;<strong>The Dreamers</strong>&#8221; followed. They sang it almost entirely. A record released in 2008, in the , &#8220;The Gift&#8221; &amp; Electric Masada tradition, but with Zorn playing the &#8220;conductor&#8221;. Delirious, a musical panacea that Zorn offers us these days. Apostrophizing and light in the same time, lively and solemn, full of specific dichotomies to the personality of one of the greatest smart sound creators on the contemporary music.</p>
<p>For me this concert stays a standard. Zorn&#8217;s activity too. He&#8217;s a diamond. Live, i saw two sides of him. I&#8217;ll stop with the metaphor, i believe i said enough.</p>

<p>No pictures, no filming, he was pretty strict about it. Instead, i&#8217;m glad i can describe this to you.</p>

<p style="text-align: left;">Maybe this action is useless: so what if we found out very fast what happens in Iran through Twitter or Google Search? SO WHAT? Your fast sentimental reaction is in vain if it&#8217;s not associated with an action according to the propagation speed.</p>
<p>We took knowledge, we assumed this cause as if it were the country we live in, we colored our headers in green, we spread subjective (partial) information that we took for granted from Google and Twitter. What does this chaotic movement mean? What does it demonstrate?</p>

Even if it&#8217;s called Iran, China, Cuba, Romania, beyond the cultural and religious differences, the individual has a common denominator. FREEDOM OF HUMAN SPEECH, this is the binder between Buddha, Allah, Christ, Jah-Jah&#8230;</p>
<p>Maybe we are dealing with a mass manipulation generated and maintained by the Internet. The individual is flooded with information regarding the protests in Iran, touched and revolted by the images from over there. The online has this power to disperse information and generate sentimental reactions. But less action. It&#8217;s good to know what happens in Iran and in other totalitarian regimes, it&#8217;s OK to make common cause with the freedom of speech manifestation, but how do we act?</p>
<p>By the way, tourism in Cuba is it&#8217;s main source of income&#8230;</p>

			<content:encoded><![CDATA[<p>Being a OS X user, I didn&#8217;t get to test Google Chrome until now. Although, as I have read about it in tutorials and seen on You Tube, I could conclude that Google Chrome is a useless application, it doesn&#8217;t bring anything new, <a href="http://www.onedaywithoutgoogle.org/blog/google-policy-or-googlization-of-politics/" target="_blank">it does not create and does not satisfy any need</a>, it doesn&#8217;t offer something new to the user. I guess I could say that this product was not made for the user.</p>
<p>Today a found a <a href="http://build.chromium.org/" target="_blank">pre-Beta version</a> and I decided to test it. The default Browser I use is Safari and occasionally FireFox and Opera. I have to admit that Chrome is faster than Safari (Version 3.2.3) but that&#8217;s not enough for me. Maybe in the final version things will be different, but after reading about the Windows version, I don&#8217;t think it will be able to give me what I need.<span id="more-452"></span></p>
<p>Even if it would give me the same options as Safari or FireFox, Chromium has, in my point of view, a big problem. Adding the Google search field option in the address bar makes me feel uncomfortable. If I want to search something on Google, I go there. Having Google as a homepage is not enough anymore for the company in Mountain View and this scares the shit out of me! Looks like I haven&#8217;t ventured much when i said that the Internet is almost synonymous with Google.</p>
<p>Because I don&#8217;t have a microphone on MacMini, it&#8217;s posible for someone to find this video a little bit boring. I suggest you to play this song during the viewing.</p>

<p>Google is looking for data structures on the web that imply facts, and then grabbing it for Squared results. “It takes an incredible amount of compute power to create one of those squares,&#8230;&#8221;</p>

			<content:encoded><![CDATA[<p>The next &#8220;Google killer&#8221;, <a title="Googgle killer service" href="http://www.wolframalpha.com/" target="_blank">Wolfram|Alpha</a> service from the creator of Mathematica &amp; the New Kind of Science, <a title="Stephan Wolfram" href="http://www.stephenwolfram.com/" target="_blank">Stephan Wolfram</a>,  will be launched in next days. According to Stephen Wolfram, the goal of Alpha is to give everyone access to expert knowledge and the data that a specialist would be able to compute from this information.</p>

<p>Instead of searching the web for info, Alpha is built around a vast repository of curated data from public and licensed sources. Alpha then organizes and computes this knowledge with the help of sophisticated Natural Language Processing algorithms. According to Stephen Wolfram, Alpha is built on top of 5 million lines of Mathematica code which currently run on top of about 10,000 CPUs (though Wolfram is actively expanding its server farm in preparation for the public launch).</p>
<p>Alpha will come in a free version, but there will also be a paid version, which will allow users to download and upload data to Alpha. Stephen Wolfram did not go into too much detail, including pricing, but pro users will, for example, be able to not just see a graph, but also download the data behind this graph for use on their own machines or in Mathematica.</p>
<p>The tool will kill Google? <br />
<strong>No, not at all,<span style="font-weight: normal;"> </span></strong>maybe it is actually wrong to call it a search engine at all (and Wolfram prefers to call it a &#8220;<strong><em>computational knowledge engine</em></strong>&#8220;). If you wanted to know what sights to see on your next trip to Moscow, for example, Alpha, from what we&#8217;ve seen so for, will not be able to help you.</p>
<p>Alpha, however, will probably be a worthy challenger for Wikipedia and many textbooks and reference works. Instead of looking up basic encyclopedic information there, users can just go to Alpha instead, where they will get a direct answer to their question, as well as a nicely presented set of graphs and other info.</p>

In the year 2008, means of information have diversified, information travels fast and owning real information became the most important weapon. The whole world is involved in a very expensive war against a more or less invisible enemy: terrorism. USA assumed the role of the leading warrior against this enemy, by any means. At the same time, a new economic crisis hits the entire world and mainly USA. The situation is similar with the 30&#8217;s and this time the Internet is the main mean of communication.</p>

<p style="text-align: justify;">Barack Obama is heavily exploiting the power of the internet using the most popular, the main search engine, Google. Google CEO Eric Schmidt supported Obama during his election campaign and even if he claims that this is a personal option, when you are named Eric Schmidt and you have such a position, your personal options remain within the walls of your own bedroom.</p>

<p style="text-align: justify;">Google knows best the users&#8217; options, their needs, this is why it launches services and products that meet our needs. Most of the time, the products/services Google offer are so great, you don&#8217;t even have to search for an alternative. The reason for which they perfectly satisfy your needs is that they created those needs.</p>
<p style="text-align: justify;">That being said, couldn&#8217;t we assume that the Google support did not only consist of a $487,355 donation? It may sound like a conspiracy theory, but I consider it to be just free imagination. We are not saying that the support Google offered Obama was a bad thing. We&#8217;re not saying it was a good thing either. It&#8217;s just free imagination.</p>

<p style="text-align: justify;">As we all know, after Hitler took control, everyone in Germany got radio receivers that gave them access to information according to the Fuhrer&#8217;s instructions. No information was published without the consent of the propaganda staff. Nowadays, the means of communications are not reduced to a simple radio receiver. We have countless sources of information, but it&#8217;s clear that the internet is the most important one. And as the internet becomes more and more synonymous with Google, the same Google which helped Obama win the elections, is it possible for Obama to control the mean that got him victory in the elections? Because, in the same way it helped him, it can easily destroy him and in this case Obama has only 2 solutions: to control or to destroy Google.</p>

<blockquote><p>On <strong>Tuesday, April 21st at 20:00</strong>, the ITRE report of the Telecoms Package, rapported by Catherine Trautmann, will come to a vote in the ITRE (Industry, TRansport, Energy) committee.</p>
<p>It may <strong>reintroduce amendment 138 (now renumbered amendment 46), a crucial safeguard of user&#8217;s rights on the Internet, and protection against the media industry private police and retribution called the &#8220;graduated response&#8221; or &#8220;three strikes&#8221;</strong> schemes. Am. 138 was approved by 88% of the European Parliament in first reading, on September 24th, 2008.</p>
<p>Yet rapporteur Catherine Trautmann is currently negotiating with the Council of the EU, which under the French presidency, and under very strong influence from M Sarkozy, deleted the amendment in first reading.</p>
<p><strong>The Council may propose a compromise version of amendment 138/46 that is completely neutralized</strong>, or that may even become the opposite of the original by allowing the &#8220;three strikes&#8221; scheme instead of preventing it. According to the latest negotiations, <strong>am.138/46 wouldn&#8217;t anymore be an <em>article</em> (that must be transposed by Member States in their law) but a mere <em>recital</em> that has just indicative value.</strong></p></blockquote>

			<content:encoded><![CDATA[<p>Since the beginning of 18th of march i was overwhelmed with emotions, waiting to see and hear <strong>Wayne Shorter</strong>. The three hours road to Budapest seemed to last 50. After we parked, we took a short tour of the surroundings to find a restaurant, so we went to Bohema, a coquet restaurant in <strong>Palace of Arts</strong>. As we were making our orders, at a near table they showed up: <strong>Brian Blade</strong>, <strong>John Patitucci</strong> and <strong>Danilo Perez</strong>. In my mind, the concert had already started.</p>
<p><span id="more-234"></span></p>
<p>The hall was full, about 1500 people. Creme de la creme of Budapest. The first symphony, performed by <strong>Wayne Shorter</strong>, was an hour and a few minutes long. Yes, symphony, the contemporary music of the 21st century, something above the classic jazz and the free jazz that <strong>Wayne Shorter</strong> has accustomed us to along his 75 years of age. With musicians that can play solo recitals on their own, on any stage in this world: <strong>Brian Blade - drums</strong>, <strong>John Patitucci - classic bass</strong> si <strong>Danilo Perez - piano</strong>.</p>
<p>I&#8217;ve listened the solo albums of the giant Shorter a few times, and also the co-operations he had beside/toghether with Miles Davis, Joe Zawinul &amp; Weather Report. The yesterday concert in Budapest made me believe i don&#8217;t know him at all. It was completely different. All i know is that it was a dream, a two hour dream, with the two encores included. Three delirious moves impeccable executed, ring in my ears, even at the moment.</p>
<p>A Patitucci that sounded spectacular, a Blade that broke a pair of drumming sticks and crushed down his drums keeping his constant rhythm, abrupt and sturdy, a Danilo Perez that kept a  dialogue in a perfect celestial harmony with Wayne&#8217;s saxophone in another world. An extremely beautiful world. And, especially, i felt <strong>Miles Davis</strong>. He was floating above us all. It&#8217;s a peculiar sensation, filled with unnatural, but in the same time it&#8217;s the result of the music of the four people we talked about.</p>
<p>And another thing. I felt privileged to listen to these people playing live, and in the same time senseless the next morning. It&#8217;s the prerogative of all the big concerts, and the risk you consciously assume.</p>

<blockquote><p>Like most Americans, I use Google&#8217;s search engine several times a day without so much as a second thought. It was only in 2007 that my company&#8217;s relationship with Google, Inc. temporarily escalated to that of a full-fledged customer, when Think Computer Corporation became yet another a Google AdWords advertiser. (AdWords advertisements appear on the right side of the main Google search results.) Sadly, the several ad campaigns we tried during this brief experiment failed miserably to bring in any new revenue, and so I personally went back to being just another user of Google&#8217;s search service&#8211;at least until March, 2008. That&#8217;s when my company signed up for the flip side of Google&#8217;s advertising juggernaut: AdSense. In anticipation of a new product, Think had acquired a brand new domain name that was unexpectedly receiving a high volume of internet traffic. Instead of paying Google for Think&#8217;s ads, I thought it might make more sense for Think to get paid for displaying Google&#8217;s.<span id="more-223"></span></p>
<p>Everything went according to plan until 11:00 A.M. on December 9, 2008. With a single click, a faceless Google employee decided that Think Computer Corporation&#8217;s membership in the AdSense program &#8220;posed a significant risk to our AdWords advertisers,&#8221; and the account was disabled with no warning. Trying to sign into the AdSense management site brought not the familiar user interface, with its limited account payment records and reports (including what Google currently owed Think, which amounted to approximately $721.00), but the following unhelpful statement, and nothing more:</p>
<p><strong>Your AdSense account for this login is currently disabled. We recommend checking your email inboxes for any messages we may have sent you regarding your account status. Sometimes our messages can be caught by email filters, so please be sure to check the Bulk/Spam folders of your email accounts as well.</strong></p>
<p><strong>Return to AdSense home.</strong></p>
<p>Knowing only that I was somehow posing &#8220;a significant risk&#8221; to advertisers, I e-mailed Google to ask about exactly what had happened. An errant automated response told me that my records could not be found. Going back and using the on-line appeal form on the AdSense web site similarly yielded no result; not even a confirmation that the appeal had been received. In the appeal I offered to send Google hundreds of pages of log files to prove that no fraud had taken place, but no one replied.</p>
<p>More than once, I tried calling Google at its corporate offices in Mountain View. Invariably the person on the other end of the line sounded like they were approximately my age, and there&#8217;s a chance I might have even gone to college with some of them, but despite all of those similarities the difference in bureaucratic flexibility could not have been more vast. While I was capable of authorizing any action on behalf of my company, Google&#8217;s overachieving receptionists were not even permitted to transfer my phone call to AdSense customer service. There was no AdSense customer service. Even if there had been, it would not have mattered much. I also couldn&#8217;t be transferred to any of the engineers who worked on AdSense. Or product managers. Or executives. It made no difference that I was also a paying AdWords customer.</p>
<p>Trying a more aggressive approach, I tried instead to be transferred to the legal department. That, too, was not an option. Despite the clear existence of the legal department, I was told again and again that I was not allowed to speak with anyone in it. For the time being, I gave up.</p>
<p>Two days after the account was disabled, on December 11, 2008, Google&#8217;s AdSense team posted a message on its blog introducing a new system called &#8220;AdSense for Domains.&#8221; Unlike normal AdSense (&#8221;for Content,&#8221; as it was then re-branded), AdSense for Domains was designed to be used by web sites that were effectively blank. When I had tried to sign up for it previously, given that my domain name needed exactly such a service, it had been &#8220;closed&#8221;&#8211;code for &#8220;available to a limited number of companies with large numbers of domain names.&#8221; Now, I was once again enraged since Google could have easily allowed me to switch over to their new service if they had merely waited two days.</p>
<p>Another flurry of phone calls to the AdSense employees who had written on the corporate blog got me nowhere. I left voicemails about my disabled account diligently, to no avail. I even called AdWords customer support, intentionally asking for the wrong department to see if a real human being could help. These efforts netted a relatively quick e-mail rejection of my appeal form, and fairly unbelievable recordings of telephone calls with Google employee Adam C. When questioned, &#8220;Can I just ask in general why you guys have a support team for AdWords, but not AdSense?&#8221;, the knowledgeable Mr C. replied, &#8220;I do not know.&#8221; When asked, &#8220;Is there a project manager,&#8221; he replied, &#8220;There&#8217;s no one I&#8217;d be able to transfer you to.&#8221; I was able to get an e-mail address for the legal department, so I e-mailed legal@google.com&#8211;and never received a reply. In the meantime, I tried to figure out what to do with my web site since I couldn&#8217;t use AdSense anymore.</p>
<p>I found Sedo, a European company that had a contract with none other than&#8211;you guessed it&#8211;Google AdSense&#8211;to display advertisements on placeholder web sites. By signing up with Sedo, I could once again use AdSense, but with one small catch. Since Sedo was the middleman, my effective rate of payment per click was somewhere between 1/5,000th and 1/10,000th of what it had been previously. Despite all of its well-meaning claims about its Terms and Conditions, it appeared that Google was willing to pay for my web site traffic after all&#8211;so long as it wasn&#8217;t me receiving the money.</p>
<p>I&#8217;d already posted once on the AdSense Forums, where thousands of AdSense partners regularly asked questions and voiced gripes about the program, so I thought it wouldn&#8217;t hurt to post again, hoping someone from the Google legal team might see my concern. Again, there was no reply.</p>
<p>I looked up the profiles for the &#8220;AdSense Experts&#8221; who answered questions in their official roles as forum moderators. Each expert had a different crayon stick-figure picture, and (useless) information about their favorite food or town, but no contact information&#8211;not even an e-mail address. With undoubtedly hundreds of employees working on advertising alone, all of them completely unreachable except in heavily scripted contexts, Google&#8217;s amazing money machine was starting to look a bit more like the type of Potemkin Village the parents of the company&#8217;s founders had fled decades before.</p>
<p>I spoke with Adam C. of AdWords once more on the phone. After pointing out that in the United States of America, the accused are generally given the right to know both the crimes they are being accused of, and the identities of their accusers, Mr. C. responded by saying that such thinking did not apply to Google&#8217;s terms of service. Effectively, Google&#8217;s position was that it was above the law, and if not any law in particular, then at least the spirit of the law. Irked, I decided to find out if such a position was tenable.</p>
<p>On January 15, 2009, I walked over to the Santa Clara County courthouse in Palo Alto, which conveniently fell within the same county lines as Google&#8217;s home of Mountain View, and filed a <a href="http://www.sccaseinfo.org/pa6.asp?full_case_number=2-09-SC-005907">civil small claims lawsuit</a> for $721.00&#8211;the amount Google owed Think when it disabled the account&#8211;using form SC-100. For a total of $40.00 in court fees, I arranged for Google, Inc. to be served by certified mail. The hearing was scheduled for March 2, 2009.</p>
<p>Since lawyers are not permitted in small claims court, Google instead sent Stephanie Milani, a Litigation Paralegal. During the short last-ditch-resolution period before the hearings on the afternoon schedule began, Ms. Milani argued that I must have done something wrong to deserve my fate. When I asked her what, she didn&#8217;t know. The AdSense engineers had not told her.</p>
<p>&#8220;Google can terminate your account for any reason,&#8221; she told me.</p>
<p>&#8220;Not any reason,&#8221; I said. &#8220;Not because I have blue eyes. Or brown eyes.&#8221; After being told to quiet down by the courtroom guard, we decided that we had reached an impasse, exchanged documents, and went back into the court room.</p>
<p>Arguing before that day&#8217;s <em>pro tempore</em> judge, I pointed out that my company had done nothing wrong to deserve termination of the contract, that Google could not prove any wrongdoing, that Google&#8217;s fraud detection algorithm was imperfect by definition (since one cannot intuit moral intent through mathematical analysis), that advertisers must already agree to bear risk as part of the AdWords terms and conditions (clause 5), and that Google had gone to great lengths (including eliminating the ability to view account records) to make it difficult to dispute anything&#8211;all while owing Think money. In fact, terminating accounts for &#8220;posing significant risk&#8221; just when they started to earn significant amounts of money seemed like a great way for Google to cut accounting liabilities in a difficult economic climate. After my explanation, the judge had a question.</p>
<p>&#8220;What was the reason Google gave you for disabling your account?&#8221;</p>
<p>&#8220;Beyond, &#8216;posing a signficicant risk to advertisers,&#8217; they didn&#8217;t give a reason.&#8221; I said. &#8220;I don&#8217;t know.&#8221;</p>
<p>Google&#8217;s Ms. Milani didn&#8217;t know either. She argued that advertisers had already been refunded my $721.00, even if they hadn&#8217;t asked for a refund. She claimed that Google could terminate accounts for any or no reason, and that I had agreed to such terms by signing up for AdSense in the first place. She even said that I&#8217;d admitted to violating the terms of service when I sent in my appeal form, because I had mentioned that my new domain name was only a placeholder site.</p>
<p>In fact, clause 6 of the AdSense for Content Terms and Conditions does not allow Google to terminate accounts for &#8220;no&#8221; reason&#8211;only &#8220;any&#8221; reason. Much to my amusement, the judge interrupted her to make a point that sounded familiar.</p>
<p>&#8220;But you couldn&#8217;t terminate my account because of the color of my eyes, could you? I have brown eyes. You couldn&#8217;t terminate my account because of that.&#8221;</p>
<p>Ms. Milani reiterated her previous arguments, but the judge didn&#8217;t buy them. &#8220;I don&#8217;t think I have the power here in Palo Alto small claims court to make you reinstate his account, but I think you owe this young man $721,&#8221; he said finally. &#8220;I think there might be money in Google&#8217;s treasury for that.&#8221;</p>
<p>In the end, printed on a baby blue sheet of paper by the clerk&#8217;s aging dot matrix printer, the judgment was actually entered for $761.00 total, due to the $40.00 court costs. I couldn&#8217;t help but to smile in front of the judge.</p>
<p>&#8220;But it&#8217;s not fair!&#8221; Google&#8217;s paralegal protested. &#8220;What if everyone whose account was cancelled sued Google?&#8221;</p>
<p>It&#8217;s a valid question. Yet until Google changes its policies to become more transparent, which might also reassure skeptics that AdWords and AdSense, which have oddly limited reporting capabilities, aren&#8217;t just two sides of the same ponzi scheme (for why else would one want to <em>terminate</em> legitimate accounts with high monthly liabilities when they&#8217;re supposed to be <em>making</em> money for Google on each click?)&#8211;I will give this answer:</p>
<p>Maybe everyone whose account was cancelled, should.</p></blockquote>
